1. What Is Fun AI Creator

Fun AI Creator is an online platform that aggregates multiple third-party AI image and video generation models into a single service. Users can create AI-generated images and videos by providing text prompts (descriptions) or uploading source images.

What you are purchasing: Access to our platform and the ability to use credits to generate content through integrated AI models. Credits are consumed on a per-generation basis depending on the model and output type. We do not sell AI models themselves — we provide access to them through our unified interface.

All generations are processed by third-party AI providers (such as OpenAI, Midjourney, Kling, Runway, and others). Fun AI Creator acts as an intermediary platform, not the creator of the underlying AI technology.

2. Account, Subscription & Credits

2.1 Account Registration

You must create an account to use Fun AI Creator. You may register using Google OAuth or email/password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use our service.

2.2 Subscription Plans

We offer monthly and yearly subscription plans that include a fixed number of credits. Credits are the platform currency used to pay for each generation. The number of credits consumed per generation varies by model type, output quality, and duration (for videos). Current credit costs are displayed before each generation.

• Subscriptions automatically renew at the end of each billing period unless cancelled.
• Yearly plans are billed upfront for the full 12-month period.
• We may change plan prices with 30 days notice. Price changes do not affect active subscriptions until renewal.

2.3 Credits & Usage Rules

Credits are tied to your account and cannot be transferred, sold, or shared with other users. Credit rules:

• Credits from subscriptions are added to your account at the start of each billing cycle.
• Unused credits from subscriptions roll over for up to 3 months, after which they expire.
• Credits purchased as one-time packs do not expire.
• Credits are consumed immediately when you click "Generate," before the generation process begins.
• If a generation fails due to platform or model error, credits are automatically refunded to your account (see Section 7).
• If you cancel your subscription, any remaining credits from that subscription remain usable until the end of your current billing period or until they expire, whichever comes first.

3. Cancellation Policy

You may cancel your subscription at any time from your Account Settings page. Cancellation takes effect at the end of your current billing period:

• Monthly subscriptions: Cancellation stops auto-renewal. You retain full access until the end of the current month. No partial refunds for the current month.
• Yearly subscriptions: Cancellation stops auto-renewal. You retain full access until the end of the current annual period. No partial refunds for the remaining months, except as specified in our Refund Policy.
• After cancellation, you may continue to use any remaining credits until they expire or are depleted.

In summary: refunds are available within 7 days of purchase for unused subscription credits, subject to our discretion. Credits consumed for successful generations are generally not refundable. Failed generations are automatically refunded.

5. Prohibited Uses

You may not use Fun AI Creator for any of the following purposes. Violation may result in immediate termination of your account, deletion of content, forfeiture of credits, and denial of refunds:

• Illegal activities: Fraud, scams, phishing, identity theft, money laundering, drug trafficking, weapons trafficking, or any other violation of applicable laws.
• Adult / NSFW content: Sexually explicit content, nudity, pornography, or sexually suggestive depictions of any kind. This includes AI-generated adult content even if fictional.
• Harm to minors: Any content depicting, promoting, or normalizing the sexualization, exploitation, abuse, or endangerment of minors (including AI-generated or fictional representations).
• Deepfakes & impersonation: Non-consensual deepfakes, synthetic media designed to impersonate real individuals without permission, or creation of false evidence.
• Hate speech & harassment: Content promoting hatred, discrimination, violence, or harassment against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Intellectual property infringement: Generating content that infringes on copyrights, trademarks, trade secrets, or the publicity/privacy rights of others — including generating images in the style of named artists without permission, recreating copyrighted characters, or using protected brand identities.
• Misinformation: Generating misleading political, medical, financial, or legal content intended to deceive, manipulate, or defraud. This includes fake news, forged documents, and deceptive marketing.
• Platform abuse: Automated bot usage, API abuse, credit exploitation, circumventing rate limits, reverse engineering, scraping, or any activity that degrades service for other users.

This list is not exhaustive. We reserve the right to determine what constitutes prohibited use at our sole discretion. See also our Acceptable Use Policy for more detail.

6. AI-Generated Content & User Responsibility

You are solely responsible for:

• The text prompts you input into the platform.
• Any images, videos, or other materials you upload.
• How you use, distribute, publish, or commercialize the generated output.
• Ensuring your use of generated content complies with all applicable laws, platform terms of destination sites, and the rights of any third parties.

No warranty on output: AI-generated content may contain inaccuracies, artifacts, unexpected elements, or outputs that do not match your intent. We do not guarantee the quality, accuracy, suitability, or originality of any generation. You should review all output before use, especially for professional, commercial, or public-facing purposes.

Intellectual property: You retain rights to the content you generate using our paid plans (subject to the underlying AI model provider's terms). However, because AI models are trained on broad datasets, we cannot guarantee that generated output is entirely free from similarities to existing works. It is your responsibility to verify that your use of generated content does not infringe third-party rights.

7. Service Availability, Failures & Credit Refunds

Fun AI Creator relies on third-party AI model providers. The following situations may occur and do not constitute a breach of our terms:

• Model downtime: Individual AI models may become temporarily unavailable due to maintenance, capacity limits, or provider issues. We will display model status when possible and offer alternatives.
• Generation queues: High demand may result in queued generations with longer wait times than average.
• Generation failures: Due to the probabilistic nature of AI, generations may occasionally fail, timeout, or produce unusable output. Failures caused by platform or model-side issues result in automatic credit refund.
• Content filtering: Our systems or third-party providers may refuse to process prompts that violate safety policies. In such cases, no credits are consumed.

Credit refund for failed generations:

• If a generation fails due to platform error, model error, or timeout, credits are automatically refunded to your account within minutes.
• If you believe a failure occurred but credits were not refunded, contact support with your generation ID.
• Generations that produce output but are "unsatisfactory" to you (wrong style, poor quality, not matching intent) are not considered failures and are not refundable. See our Refund Policy.

8. Account Suspension & Termination

We reserve the right to suspend or terminate your account without prior notice if we determine, at our sole discretion, that you have:

• Violated these Terms, our Acceptable Use Policy, or any applicable law.
• Generated prohibited content (see Section 5).
• Engaged in platform abuse, fraud, or payment disputes (chargebacks without first contacting support).
• Created multiple accounts to exploit free trials or promotions.

Upon suspension or termination:

• Your access to the platform will be immediately revoked.
• Any unused credits may be forfeited without refund.
• Generated content associated with your account may be deleted.
• You may not create a new account without our express permission.

If you believe your account was suspended in error, you may appeal by contacting our support team. We will review appeals within 7 business days.

9. Limitation of Liability

Fun AI Creator is provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
• Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not responsible for the content, accuracy, or legality of AI-generated output. You assume full responsibility for how you use generated content.
• We are not responsible for the acts or omissions of third-party AI model providers.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email and/or a prominent notice on the platform at least 14 days before they take effect. Your continued use of Fun AI Creator after changes take effect constitutes acceptance of the revised terms.
